1. Who we are

JustBookDirect.com is operated by Garcia Ventures, a sole proprietorship based on Vancouver Island, British Columbia, Canada. By using this site to book or list a property, you agree to these terms.

2. What we do - and what we don't

JustBookDirect is a booking platform that connects guests with independent property owners. We facilitate the connection, process payment securely through Stripe, and pass the owner's share directly to them.

We are not the owner, operator, or manager of any listed property, and we are not a party to the accommodation arrangement between a guest and an owner. The owner is solely responsible for their property, its condition, its accuracy as listed, and their guests' stay. JustBookDirect is not responsible for the condition of any property, the conduct of any guest or owner, or any dispute arising between a guest and an owner.

3. No warranty

This platform and the listings on it are provided "as is." We do not guarantee the accuracy of any listing, the availability of the platform at all times, or that your experience will be free of errors or interruptions. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

4. Limitation of liability

To the fullest extent permitted by law, JustBookDirect and Garcia Ventures will not be liable for any indirect, incidental, or consequential damages arising from your use of this platform, a booking made through it, or a property listed on it - including but not limited to property damage, personal injury, loss of enjoyment, or financial loss. Where liability cannot be fully excluded under applicable law, our total liability to you is limited to the platform fee we actually received for the specific booking in question.

5. Your responsibility, and holding us harmless

If you are a guest, you agree to conduct yourself responsibly during your stay and to resolve any issue with the property directly with its owner in the first instance. If you are an owner, you agree that you are solely responsible for your property, your guests' safety while there, and compliance with all laws that apply to you (including short-term rental regulations and tax obligations).

Both guests and owners agree to hold JustBookDirect and Garcia Ventures harmless from any claim, loss, or expense arising from their own conduct, their property, or their stay - except where that claim arises directly from our own negligence in operating the platform itself.

6. Fees

Listing a property is free. JustBookDirect charges a platform fee (currently 10%) on each completed booking, calculated on the nightly rate. This fee, along with any applicable taxes, is included in the total price shown to the guest at checkout.

7. Payment

Payments are processed by Stripe, an independent third-party payment processor. We are not responsible for Stripe's availability or performance. Standard bookings require 50% of the total at the time of booking, with the remaining balance charged automatically to the same payment method the day before check-in. Owner payouts transfer automatically and directly to the owner's own connected Stripe account - JustBookDirect does not hold guest or owner funds.

8. Cancellations & refunds

Cancellations made 14 or more days before check-in are eligible for a full refund of amounts paid. Cancellations made within 14 days of check-in are subject to a reduced refund policy. All cancellation requests are reviewed before a refund is processed.

9. Privacy & your information

We collect the information necessary to process your booking or listing application - name, email, phone number, and payment details (handled directly and securely by Stripe; we do not store your card information). We do not sell your personal information to third parties. Information may be used to contact you about your booking or listing, and, with your consent, about future offers.

10. Governing law

These terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.

11. Changes to these terms

We may update these terms as the platform evolves. Material changes will be reflected on this page with an updated date. Continued use of the platform after a change means you accept the updated terms.
